Registration of Marriage Abroad
  • The spouse of Brazilian nationality must be present for Marriage Registration. 
  • If both spouses are Brazilian, the application form for Marriage Registration must be completed and signed by the spouse who will personally report to the Consulate-General to sign the Marriage Registry.
  • Once the marriage has been officially registered at the Consulate, a Certificate of Marriage Registration (“Certidão de Registro de Casamento”) will be issued to the couple. 
  • To avoid having to appear twice at the Consulate General, read the Recommendations listed after the Instructions.
  • The department within the Brazilian Consulate responsible for Registration of Marriage Abroad is Notary Acts.
 

 
I- Requirements for a Marriage Registration
 
1) Completed Marriage Registration application form (“Formulário para Registro de Casamento”)signed by the spouse with is a Brazilian citizen. The spouse who signs the application must be the same spouse who appears at the Consulate-General to sign the Marriage Registry. If both spouses are Brazilian, the application form for Marriage Registration must be completed and signed by the spouse who will personally report to the Consulate-General to sign the Marriage Registry. 2) Documents required from each spouse:
 
PLEASE NOTE: All ORIGINAL documents must be presented on the day that the Marriage Registry is signed. One COPY of each of the following documents may be sent in advance before bringing the originals. Please see RECOMMENDATIONS below for further instructions.
 
For spouse(s) of Brazilian nationality:
a)       Official copy (“2da via”) of Birth Certificate issued in the past six (6) months; OR
b)      Marriage Certificate with Divorce Certificate (“averbação de divórcio”). If the divorce did not take place in Brazil, the Divorce Certificate must be ratified by the Superior Tribune of Justice before the new marriage can be registered); OR
c)       Marriage Certificate with Death Certificate (“certidão de óbito”) of the deceased spouse; OR
d)      Testimony of two (2) witnesses who are Brazilian citizens and who are not family members, attesting that the individual is not currently married. A notary public must notarize the signatures of both witnesses. ClickHERE for declaration document.
 
For a spouse who is not a Brazilian citizen:
a)       Certified Copy of Birth Certificate;
b)      If their civil status was one other than single, a notarized copy of Divorce Certificate or Death Certificate of deceased spouse.
 
IMPORTANT: If the spouse is not a United States citizen, the Birth Certificate and Divorce or Death Certificate, when applicable, must be legalized by the Brazilian Consulate that has jurisdiction over where the document was issued.
 
3) Certified Copy of Marriage Certificate
Certified Copy of Marriage Certificate, which will be stored in the Consulate-General’s files, as required by Brazilian law.
 
 4) Consular Fee
      a) The cost of the Certificate of Marriage Registration is US $20.00.
      b) The cost of each additional copy is US $5.00.
 
 

II – Method of Payment
 
The Consulate-General of Brazil in Chicago ONLY accepts payments in the form of a Money Order issued by the United States Postal Service (USPS), payable to the “Consulate-General of Brazil in Chicago.” 
 

 


 III- Processing Time
 
Five (5) business days after receipt of complete application and all required documents. The processing time may increase in times considered high season.
 
 

RECOMMENDATIONS
 
To avoid having to appear twice at the Consulate-General (first to present application documents and a second time to sign the Marriage Registry), we recommend the following procedure:
 
1)       Send a copy of the application materials listed above to the Consulate-General in Chicago via:
    a) Mail- 401 North Michigan Avenue, Suite 1850, Chicago, IL 60611
    b) Fax- (312) 464-0299 ATT: Notary Acts
 
PLEASE NOTE: The Consulate-General of Brazil in Chicago ONLY accepts mail correspondence via United State Postal Service (USPS).Envelopes transported by other carriers will be returned without opening. The Consulate will not be held responsible for delays or losses of documents or Money Orders sent or returned by mail. For the most secure and rapid delivery, the Consulate strongly suggests the use of USPS Express Mail.
 
2)       Report to the Consulate-General to sign the Marriage Registry on the date determined by the Consulate-General.
 
IMPORTANT: For verification purposes, all original documents must be presented on the day that the Marriage Registry is signed.
 
SUBSEQUENT MEASURES TO BE TAKEN IN BRAZIL
In order to officially register the marriage in Brazil, one must bring the Certificate of Marriage Registration (“Certidão de Registro de Casamento”) issued by the Brazilian Consulate to the Registry Office of the First Office of the Civil Registry (“Cartório do Primeiro Ofício do Registro Civil”) of either the individual’s hometown OR of the Federal District, which has jurisdiction over the entire national territory.
