PERMANENT VISA BASED ON FAMILY REUNION FOR DEPENDENTS OF BRAZILIAN NATIONALS OR OF FOREIGNERS WHO HOLD A PERMANENT VISA ("RN 36/99")
I - ELIGIBILITY:
► Foreigners married to Brazilian nationals, or to foreigners who hold a Brazilian permanent visa;
► Parents of a foreigner married to a Brazilian national, or of a foreigner who holds a Brazilian permanent visa, if duly demonstrated that the petitioner (i.e. the Brazilian citizen or the foreigner who holds a Brazilian permanent visa) is financially responsible for them;
► Single sons/daughters of a foreigner married to a Brazilian national, or of a foreigner who holds a Brazilian permanent visa. These sons/daughters must be under 21 years of age, or above that age if they are incapable of financial self sustain;
► Brothers/sisters, grandchildren or great-grandchildren of a foreigner married to a Brazilian national, or of a foreigner who holds a Brazilian permanent visa. These dependants must be orphan, single and under 21 years of age, or of any age if they are incapable of financial self sustain;
Notice: The 21 years of age limit referred to in items "3" and "4" above can be extended until the year they complete 24 years of age, if they are enrolled in an under-graduate or graduate course, and provided there is reciprocity of treatment for Brazilian nationals.
Visa Submission: Candidates for permanent visa must submit their application in person at the Consulate General.
II - DOCUMENTATION REQUIRED
A - FROM THE PETITIONER (BRAZILIAN CITIZEN OR FOREIGNER HOLDING A BRAZILIAN PERMANENT VISA)
1) "Carteira de Identidade" or "Carteira de Registro Nacional de Estrangeiro - RNE" issued in Brazil.
2) "Compromisso de Manutenção" Form, duly filled out and signed by the petitioner (click here).
B - DOCUMENTS REQUIRED FROM THE FOREIGN VISA APPLICANT
1) Foreign spouse of a Brazilian national
The Brazilian marriage certificate

2) Dependents of a foreigner who holds a "RNE"
· marriage or birth certificate as proof of relationship;
· proof of incapacity of financial self sustain.
3) Non-criminal record
not exceeding 90 days, issued by the Police Department of the applicant’s place of residence. The document must have an official signature as well as a stamped or raised seal of the Police Department. Printouts of computer-generated criminal records are not accepted.
4) Proof of residence in the consular jurisdiction
for US citizen: a valid driver's license or a State I.D;
for non-US citizen: a Resident Alien Card -"Green Card" or an American visa along with the I-94 form.
5) Passport
Valid for at least six months, with two consecutive blank pages.
Non US citizens:
Must also present proof of legal residency in the US such as a photocopy of green card or of a valid visa in the United States, or an US Re-entrey Permit.
Visas will be issued on a "laissez-passer " to nationals of the following countries:
Bhutan, Central African Republic, Taiwan.
Important Notice: all documents listed above (except "Compromisso de Manutenção") must be presented along with two plain copies for consular legalization. The Consulate General will return the original documents and retain the legalized copies.
6) Three (3) photographs
Passport size, in color or black and white, full-face only, on a white or clear background. Instant, digital, photocopies or scanned photos are not acceptable.
7) Three (3) visa application form
The visa form must be completely filled-out, signed by the applicant (original signature) and must have an e-mail address for contact, or a phone number.
Note: One application form will be attached to the passport for the purpose of registration with the Brazilian Federal Police within 30 days of the candidate's date of arrival in Brazil.
► Minors under 18 years of age:
• A copy of the minor’s birth certificate is required in all cases;
• Their visa-application form must be signed by both parents or legal gardians. A Notary Public must notarize the signatures. Death certificates and other court documents are accepted as proof of guardianship.
8) Consular Fees:
a) Legalization of copies and signatures:
· Legalization of copies of "Carteira de Identidade" or "Carteira de Registro Nacional de Estrangeiro RNE": free of charge;
· Legalization of copies of all other documents: US$ 5.00 per page;
· Legalization of signatures ("Compromisso de Manutenção" and Non-Criminal Record): US$ 20.00 per signature;
b) Visa Fee: US$ 200.00 per applicant.
c) American citizens: additional US$ 130.00 visa-processing fee per visa, based on reciprocity of treatment.
Method of payment
The Consulate General in Chicago only accepts payments with Money Order issued by the U.S. Postal Service payable to “Consulate General of Brazil in Chicago”.
9) Processing time:
► For couples who have been married for less than five years: when all requirements are met, the documents must be sent to Brazil for the approval. Starting on the date the Ministry of Foreign Affairs formally informs the Consulate General of the approval by the proper Brazilian authorities; the processing time takes eight (8) working days.
OTHER INFORMATION
1. Documents not written in Portuguese, Spanish or English (except for travel documents): must be translated to the Portuguese language by a sworn translator before they are presented to the Consulate. Sworn translators must sign the translation and have their signature first notarized by the Notary Public and then certified by the County Clerk or Secretary of State (depending on the State).
CUSTOMS REGULATIONS APPLICABLE TO PERMANENT VISA HOLDERS
- Permanent Visa holders traveling to Brazil may carry their personal belongings in order to live in Brazil in quantities that are compatible with the size of their family/household and the nature of their work. Clearance will be done directly with the customs authorities in Brazil.
- Goods acquired at duty free shops at the airport of arrival in Brazil may not exceed US$ 500.00.
